
Towards Full Implementation of the Cartabia Reform. What Role Does the Special Administrator Play in the Minors’ Interests?
In legal proceedings, the special administrator is the professional who is authorised to represent or assist people who are unable to stand trial in order to ensure that they are not temporarily deprived of representation or assistance. Article 78 of the Italian Code of Civil Procedure deals with the role of the special administrator: the wording of this article was amended by Legislative Decree No. 149 of 10 October 2022 in order to implement the so-called Cartabia Reform.
In Family Law, several provisions require the appointment of an administrator for a minor because there are several circumstances where conflicts of interest may arise between the minor and the individuals exercising parental responsibility.
